Before a building is deemed fit for occupancy, it must comply with approved construction plans and meet certain conditions. The Department of Urban Development and Housing, which operates under the Bihar government, is responsible for issuing occupancy certificates.

The regulations for constructing buildings in Bihar known as the Bihar Building Bye-Laws, which were established in the year 2013.

According to the Bihar Building Bye-Laws of 2013, once a building is completed, the individual must fill out the appropriate application form in order to receive an occupancy certificate. An authorized officer will inspect the building and make a decision to either issue or deny the certificate within thirty days of receiving the application.

In the world of real estate, the two most commonly used certificates are the occupancy certificate and the completion certificate. While both of these certificates act as legal documents that enable the buyer to occupy the property, they differ in the sense that an occupancy certificate is issued by the local government authority when the construction of the property is complete and it is deemed fit for occupation, whereas a completion certificate declares that the construction of the property has been completed in its entirety, with all infrastructural facilities in place.

Completion Certificate 

After the construction is finished, the person in charge, whether it be the builder or the building owner, must ask the regional municipal authority for the Completion Certificate.

The authorities will only issue a Completion Certificate once they review the building approval form and ensure that the construction meets all necessary criteria, including regulations regarding the distance from the highway and the height of the structure, as well as the implementation of a rainwater harvesting system.

Occupancy Certificate 

After receiving the Completion Certificate, the applicant is required to request an Occupancy Certificate from the municipal authority in their locality.

An Occupancy Certificate confirms that a building has adhered to all the required building codes and regulations set forth by either the local governing authority or the urban development and housing department. It provides clearance to inhabit the building under the specific regulations. This certificate is exclusively provided after the whole construction process is finalized.

Documents Required 

When you submit your application, include the listed documents with the application form.

  • Completion notice in the specified layout.
  • Three sets of finalized blueprints for the building.
  • Record of Rights  relating to ownership.
  • A duplicate of the endorsed strategy and the letter of approval.
  • Whenever applicable, the designated authority must provide a certificate confirming that fire safety equipment has been installed in the building.

To obtain a Bihar Occupancy Certificate, adhere to the outlined procedures provided.

 Step 1:  To obtain the application form for an occupancy certificate, the candidate must visit the designated officer of the planning authority or chief municipal officer of the appropriate municipality.

 Step 2:  Complete the application by providing the necessary information and include the designated paperwork.

 Step 3:  Present the completed application form along with all the required papers to the relevant person at the designated location.

 Step 4:  After applying, the applicant is required to complete payment by creating a challan.

 Step 5:  Once the challan has been submitted and payment has been made, a confirmation message will be sent to the applicant’s registered mobile number and email address notifying them of the successful payment.

 Step 6:  Once the documents have been checked and confirmed, the person applying can obtain the certificate allowing them to occupy the property.

Online Application Procedure 

To obtain an occupancy certificate, the individual seeking it must adhere to the instructions provided in the following sequence.

 Step 1:  Go to the authorized site of the Department of Urban Development and Housing.

 Step 2:  Click on “  Occupancy Certificate You can select the “Building Permission” option on the portal’s homepage menu.

 Step 3:  The citizen registration form will appear on the screen that follows.

 Step 4:  In order to register as a citizen, the individual must provide the necessary information on the registration form. This will typically include specific details and personal information.

  • Applicant name
  • Date of birth
  • Email address
  • Mobile number
  • Address details

 Step 5:  To access the system, the candidate must log in using their citizen credentials and provide all necessary details.

The Bihar Occupancy Certificate Citizen Login is a system for citizens to access and obtain an occupancy certificate for their property in Bihar.

 Step 6:  It is the responsibility of the applicant to complete the occupancy certificate application form.

 Step 7:  Following the entry of information, upload the application form together with the scanned copies of the required documents.

 Step 8:  Before submitting, the candidate must make sure that all information has been entered accurately.

 Step 9:  To continue, the aspirant is required to submit a payment.

 Step 10:  Click on “  Proceed” The icon will allow you to either generate a payment gateway or a challan, depending on whether you have chosen to pay online or offline.

 Step 11:  The screen for payment information shows up, and it indicates which fields are required to be filled out, including the “ Submit”  icon has to be clicked.

The candidate will be notified through their phone number and email after completing the transaction. If the transaction is successful, they will receive an application number and reference number. The department will inform the candidate of the certificate collection date by SMS and Email after approving the application. If the application is rejected, the candidate will also be notified via SMS and Email.

Processing Time 

The process of issuing a certificate of occupancy will be finished within 30 days after submitting the application.

Concerned Authority 

The person in charge of issuing the occupancy certificate is either the Designated Officer of the Planning Authority or the Chief Municipal Officer of the relevant municipality. Sometimes, a team of officials appointed by the authority also carry out this responsibility.

A group of officials will inspect the location within two weeks and check if it meets the requirements stated in the Bye-laws. Once the Notice of Completion has been verified, the authority will grant or reject Occupancy permission within 30 days from the submission date, in accordance with the provisions of the Bye-laws.

If the Occupancy Certificate is not given within the stated time frame, the applicant must provide a statement and written proof that the construction adheres to the approved plans and that there are no outstanding payments in regards to development fees or other forms of payment. Once the notice and affidavit are submitted to the appropriate authority, the Occupancy Certificate will be issued within 15 days from the date of receipt.
